Westchester enacts law against AI-driven deep fakes

County Executive Ken Jenkins has enacted a new law in Westchester to combat the unlawful use of digitally deceptive material, commonly known as "deep fakes." These are images, videos, or texts altered by artificial intelligence to present false information. The legislation aims to close gaps in penal law concerning impersonation through AI-generated likenesses, including voice and other personal attributes.

Jenkins emphasized the importance of this law: “Using digital tools to create something that is seemingly authentic, with the intent of deceiving others, will not be tolerated in Westchester. This new law provides an additional level of protection for our residents, especially our seniors, who have increasingly fallen victim to harassment and scams.” He expressed gratitude towards the Westchester County Board of Legislators for addressing these legal gaps.

The legislation classifies the use of such deceptive content as a Class B misdemeanor, which can lead to imprisonment or fines. The offense escalates to a Class A misdemeanor if it occurs during another crime or if there is a prior conviction within ten years.

Westchester County District Attorney Susan Cacace expressed her support: “I am thankful for the partnership of our executive and legislative branches in providing this new tool to hold abusers accountable. Too often, gaps in existing laws allow advances in technology to outpace the criminal justice system.”

Chairman Vedat Gashi also praised the enactment: “I would like to thank County Executive Ken Jenkins for signing this vital bill into law today. It will help protect our residents – especially seniors and other vulnerable members of our community - from the growing threat of malicious AI use.”

Legislator Judah Holstein sponsored the legislation alongside the Westchester District Attorney’s Office and County Law Department. Holstein remarked on its significance: “AI has incredible potential, but when used maliciously, it can cause real harm... I’m proud to see this law signed today.”

The new regulation is effective immediately.
